Arbitration and Mediation

Litigation can be costly, time-consuming, and unpredictable. Depending on your circumstances, alternative dispute resolution may be an advisable alternative to litigation.

Arbitration and mediation allow parties to keep costs at a minimum, and often allow parties to have their disputes resolved more quickly than typical litigation.

In arbitration, the parties agree to have a knowledgeable and neutral third-party arbitrator conduct a hearing and decide their dispute. In mediation, the parties work together with a neutral third-party mediator to reach an agreeable resolution of their dispute. Because these alternative dispute resolution mechanisms are a product of the parties’ agreement, the rules governing them can be more flexible, more efficient, and more closely-tailored to the parties and their particular issues.

Dan Cavarello has a wealth of knowledge and experience in alternative dispute resolution, serving regularly as both a mediator and arbitrator in all types of civil cases. He is known for his patient and diligent approach and has successfully mediated hundreds of cases over the past few years. He is often selected as a solo arbitrator or to serve as the “neutral” on a three attorney panel based upon his reputation for fairness and timeliness in issuing decisions. Dan mediates and arbitrates cases in both Western (Buffalo, Rochester) and Central (Syracuse, Utica) New York and his rates are reasonable. He also offers video conferencing as an alternative to in-person sessions if agreeable to the parties.

Paul V. Mullin is also extremely experienced in alternative dispute resolution, serving regularly as both a mediator and arbitrator in all types of civil cases. He has been appointed as an approved mediator for cases pending in the Northern District of New York and the Fifth Judicial District New York State Supreme Court.  He has successfully mediated many cases over the thirty-plus years of his practice. He is often selected by Courts, private parties, and companies to address and mediate their disputes.  Paul’s reputation for excellence in the legal community has been recognized by many rating organizations and his dispute resolution results reflect his success. Paul mediates and arbitrates cases in the Northern District of New York and in the counties throughout Upstate New York. Joe Matteliano, who is highly respected for his trial and appellate experience in numerous areas of civil litigation, is asked by his peers to serve in the challenging position of sole arbitrator. He also sits as a “neutral” arbitrator on three member panels. In light of Mr. Matteliano’s vast trial and appellate experience representing defendants for insurance carriers and plaintiffs in personal injury and wrongful death cases which resulted in multi-million dollar settlements, he is uniquely qualified to serve as a mediator in civil matters.
