Partner Kevin R. Van Duser is a recipient of the 2017 America's Most Honored Professionals Award.  This is awarded by the American Registry for continuous professional recognition by trade groups, peers, and clients, and accomplishment realized by the top 1% of American Professionals.
Partner Kevin R. Van Duser is the recipient of the 2018 AV Preeminent Rating.  According to Martindale-Hubbell, AV Preeminent is the highest rating a lawyer can achieve and is a "testament to the fact that a lawyer's peers rank him or her at the highest level of professional excellence."  The ratings are based upon performance in the areas of Legal Knowledge, Analytical Capabilities, Judgment, Communication Ability, Legal Experience, and General Ethical Standards.
Partner Paul V. Mullin lectured on “The Rules of Evidence: A Practical Toolkit,” in Syracuse, New York for the National Business Institute. The seminar, held in October of 2017, was directed to litigators, and offered legal direction on evidentiary issues specific to sources such as social media and video evidence. The seminar was attended by lawyers and industry professionals who are involved in litigation in the state and federal courts of New York.
Partner Paul V. Mullin lectured on “Police Liability Claims From Start To Finish,” in Syracuse, New York for the National Business Institute. The seminar, held in October of 2017, was directed to police, municipal lawyers, and industry professionals who are confronted with constitutional claims and litigation. The seminar provided guidance on not only how to avoid lawsuits, but what to do when confronted with a lawsuit.

Pesarchick has been named chair of the upcoming Defense Research Institute (DRI) national seminar “Outsmarting the Trucking Reptile at Trial.” The seminar is scheduled for May 24, 2017 in Chicago, Illinois. The workshop promises to provide advanced, comprehensive information on how to defeat plaintiff’s reptile theory in the trucking setting. Partner Kevin Van Duser was selected as one of the “10 Best Attorneys” for New York, 2016 and 2017, by the American Institute of Family Law Attorneys (AIOFLA).  According to the AIOFLA, recognition as one of “New York’s 10 Best Attorneys” is given to lawyers who “have attained the highest degree of professional achievement in his or her field” and “have an impeccable Client Satisfaction rating”. 
The Appellate Division Fourth Department affirmed dismissal of an action, Iannarilli v. Hornby Volunteer Fire Company, Inc., brought by the estate of a women who had claimed that the volunteers were negligent in their efforts to rescue the women when they had to extricate her from her bathroom where she was trapped. The Appellate Court affirmed the trial court findings that included there was no evidence of a special duty between the woman and the volunteer fire responders.  Paul Mullin represented the Hornby Volunteer Fire Department and the individual fire responders.
The Court of Appeals on December 22, 2016 declared it established a new “fair balance" in reviewing motions by petitioners seeking to file late Notice of Claims against public entities. When a petitioner attempts to file a late Notice of Claim he/she must meet the requirements of the General Municipal Law which includes showing that there was a lack of prejudice to the public corporation if a late notice were allowed to be filed. Kevin R. Van Duser presented at the New York State Bar Association’s CLE seminar entitled Labor Law Claims, Coverage & Litigation. The topics presented on included: Additional Insured Endorsements & Coverage; Priority of Insurance in New York; Contractual Indemnification; Insurance Coverage for Contractual Indemnification Obligations; and, Pursuing 1B Coverage.
Kevin Van Duser recently attended the Defense Research Institute’s (DRI) annual Insurance Coverage and Practice Symposium, a three day conference held in New York City attended by lawyers from around the country. Throughout the conference, Mr. Van Duser participated in discussions on many insurance coverage topics including: Top 10 Insurance Coverage Decisions of 2016; An Insurer’s Duty to Settle; First Party Bad Faith; Insurance Coverage for Municipalities; Liability Insurance; Duty to Defend; Primary Versus Excess Disputes; and, International Claims.
