Stephen G. Pesarchick spoke at the Defense Research Institute's (DRI) recent seminar, in Chicago, "Defending Trucking Litigation: A Primer for Young Lawyers" on the topic of "Deposition Dos and Don'ts for Accident Reconstructionists Experts".  Steve is a member of DRI and serves as the editor of its In Transit and For the Defense publications.

Danielle Mikalajunas Fogel successfully defends family medicine physician at retrial. Plaintiff alleged a prescribed medication was not indicated and caused serious injury.  The jury again rejected the Plaintiff's allegations and found the physician not negligent.

Danielle Fogel spoke at the New York State Academy of Trial Lawyers CLE "Doctors and Their Records at Trial" on May 27th at the Syracuse University College of Law.  The panel discussion took on just about every issue that might arise in a trial involving medical evidence.

Kevin R. Van Duser spoke at the New York State Bar Association’s CLE seminar entitled Insurance Coverage Update 2015: Coverage Disputes and Litigation. The topics presented on included claims involving Ebola, Superstorm Sandy, Cyber Crimes and Ride Sharing. Mr. Van Duser discussed whether the traditional insurance policy will respond to any of these claims, as well as Business Interruption Coverage, Exclusions that may bar coverage for these claims, and creativity to find more coverage. A great day for coaches of youth sports. The Sugarman office recently, successfully, argued that the assumption of the risk doctrine applies to time in which an athlete is in the locker room after a practice. The plaintiff alleged he was injured by another player while changing after practice. The Appellate Division Fourth Department affirmed the trial court’s dismissal of the case on the basis that at the time he was in the locker room the plaintiff was still participating or involved in the activity of the sport, supporting the application of the assumption of risk doctrine. Kevin Van Duser recently attended a Defense Research Institute (DRI) conference in New York City, a three day event where he participated in discussions on a variety of insurance coverage topics including, among others, Recent Developments in Professional Liability Coverage; Winning Strategies for Presenting the Insurance Carrier to Judges and Juries; Emerging Issues in Risk Shifting, Contractual Liability, and Additional Insured Coverage; and, Bad Faith Claims.

The Sugarman Law Firm was proud to host a wish announcement party for Caden at it's newly expanded Auburn offices.  Caden found out that he will have the chance to see his favorite animal, the cheetah, while on safari in Africa.  Caden's wish is being granted with funds raised and/or donated by the Sugarman Law Firm through the Make-a-Wish Foundation of Central New York's Adopt-a-Wish Program.

Kevin Van Duser represented a mother in a custody dispute where each side was seeking physical custody of their young daughter. After a two day trial, and post-trial briefs, the court found in favor of Sugarman’s client and awarded physical custody of the child to the mother, as well as final decision making on the issues of medical and education for the child, two highly contested issues at trial.

Kevin Van Duser, assisted by Stephen Davoli and Heather Berry, represented a Financial Advisor being sued for an alleged breach of contract relating to the sale of a Financial Advisor Practice with a book of business value estimated in excess $50,000,000. It was alleged that the Sugarman client owed the seller $497,000 plus interest. A Counterclaim was served on behalf of the client alleging that that the seller violated the covenant not to compete contained in the contract for the purchase of the business.
