A motion was filed on behalf of a family medicine physician and his group seeking dismissal of plaintiff’s complaint on the grounds that he complied with the standard of care in providing preoperative clearance to a patient undergoing surgery and that his care was not a cause of the patient’s death. Following arguments, the Judge concluded that we met our burden establishing that the care was appropriate and not the cause of death, and that the plaintiff failed to create an issue of fact as their expert affidavit was speculative without medical support. The complaint was dismissed against the physician and his group.
